Juristenrunde with Julian Pehm
Julian Pehm holds a Juristenrunde lecture on the topic of 'Wucher in Vertriebsketten – „Vertriebskettenproblematik“ und mögliche Auswege am Beispiel des Arzneimittelhandels' (Price gouging in supply chains - the 'supply chain problem' and possible remedies using the example of pharmaceuticals) on Monday, 7 December 2020, 11.00h.
Julian Pehm joined the Institute for European Tort Law (ETL) as a research assistant in 2014. He read law at the University of Vienna, graduating in 2014. During his studies, Julian Pehm worked as a student assistant at the Department of Civil Law with Univ.-Prof. Dr. Stefan Perner and Univ.-Prof. Dr. Martin Spitzer and at Schneider & Schneider Rechtsanwälte, a Vienna based law firm. In 2013 he participated in the Civil Law Moot Court Competition (‘Franz von Zeiller Moot Court’) before starting his research work at ETL under the supervision of Univ.-Prof. Dr. Ernst Karner in 2014. Since then Julian Pehm has published multiple scientific articles and has held several presentations, inter alia on the topics of liability for autonomous systems, hate speech, and the protection of personality rights.
In this Juristenrunde he presents parts of his recent study on private law remedies in cases of excessive pharmaceutical pricing.
Die Preisgestaltung für dringend benötigte Waren sorgt seit jeher für bewegte Diskussionen. Am Beispiel des modernen Arzneimittelhandels erörtert Julian Pehm die Möglichkeiten zivilrechtlicher Preiskontrolle und damit verbundene Schwierigkeiten. Der Vortrag widmet sich insbesondere jenen Problemen, die sich für die traditionell am zweipersonalen Rechtsverhältnis orientierten Instrumente der Äquivalenzkontrolle in mehrgliedrigen Vertriebsketten ergeben, und skizziert mögliche Auswege. Das Vortragsthema ist Teil eines umfassenderen Forschungsprojekts zum zivilrechtlichen Rechtsschutz bei überhöhten Arzneimittelpreisen.
