Juristenrunde with Anne Marie Frøseth
Dr. Anne Marie Frøseth, Professor at the University of Bergen, Norway, holds a Juristenrunde lecture on 'Enterprise Liability Models and Challenges Arising from the Specific Risk Profile of AI Systems' on Friday, 10 November 2023, 12.00h.
In the international discourse, several authors argue that enterprise liability models could assume a central role in addressing the responsibility gap brought about by the distinctive risk profile associated with AI systems.
In this lecture, Professor Frøseth presents the fundamental characteristics of some of the proposed models and their area of use, and discusses their pros and cons, especially in regard to hospital liability. In addition, Frøseth critically examines the applicability and limitations of an existing framework for liability within Norwegian law, specifically the strict liability for technical failures related to patient injury compensation.
Furthermore, the discussed models will be compared with Article 4: 202 of the Principles of European Tort Law, and related to the ongoing debate regarding a risk-based approach to liability within the European Union.
