ETL Workshop with Uğur Karaca

Monday 19.10.2026 03:10 pm

The Institute for European Tort Law and the European Centre of Tort and Insurance Law cordially invite you to the next ETL Workshop.

On Monday, 19 October 2026, Uğur Karaca will present his work entitled “Liability of Crypto-Asset Service Providers Arising from Cybersecurity under EU and Turkish Law.”

The presentation examines the nature and conditions of crypto-asset service providers’ liability for losses arising from cybersecurity incidents under Turkish law and European Union law. Using a hypothetical cyberattack case, it explores the relevant legal framework, with particular focus on Article 75(8) of MiCA and Article 99/B(4) of the Turkish Capital Markets Law. It further analyses whether such liability should be characterised as contractual or non-contractual, and whether it is based on fault or constitutes strict liability. Particular attention is given to the meaning and scope of the concept of an “event attributable to the crypto-asset service provider” under MiCA. Finally, the presentation evaluates the main interpretations of this concept and their implications for the scope of crypto-asset service providers’ liability.

The presentation is scheduled to last 20 minutes, followed by an opportunity for discussion. It will take place in the Seminar Room of ETL/ECTIL (Reichsratsstraße 17/2, 1010 Vienna). Participation is free of charge. If you would like to attend, please register viaetl(at)oeaw.ac.at.
